At JC Tree & Grounds Maintenance, we are committed to delivering professional, safe, and reliable arboricultural and grounds maintenance services. These Terms & Conditions explain the basis on which we provide our services and form part of any agreement made with our customers.
1. Definitions
In these Terms & Conditions:
- “Company” refers to JC Tree & Grounds Maintenance
- “Customer” refers to the person, business, or organisation requesting our services
- “Works” refers to all tree surgery, grounds maintenance, and related services carried out by us
2. Quotations
All quotations are provided free of charge and remain valid for 30 days unless otherwise stated. Quotations are based on site conditions at the time of inspection and may be revised if conditions change before work begins.
3. Acceptance of Work
Acceptance of a quotation, whether given verbally, in writing, or electronically, confirms agreement to these Terms & Conditions.
4. Cancellation Rights
Customers have the right to cancel within 14 days of accepting a quotation. If work is requested to begin within this period, charges may apply for any work completed or costs incurred before cancellation.
5. Pricing and Payment
Payment is due upon completion of the works unless otherwise agreed in writing. We reserve the right to charge interest on overdue payments. All prices are subject to VAT where applicable.
6. Access and Customer Responsibilities
The Customer must provide safe and suitable access to the site and must inform us of any hazards, including:
- Underground services
- Overhead cables
- Hidden utilities
- Restricted access
- Any other relevant site risks
We cannot accept liability for damage or delays caused by undisclosed site conditions.
7. Standard of Work
All works are carried out in accordance with current industry best practices and, where applicable, British Standard BS3998. Due to the natural characteristics of trees and vegetation, the final appearance of completed work may vary depending on species, health, and condition.
8. Waste Removal
Unless otherwise agreed in writing, all arisings such as branches, timber, and debris will be removed from the site upon completion of the works. We aim to recycle 100% of waste wherever possible as part of our environmentally responsible approach.
9. Damage and Liability
We take all reasonable care to avoid damage while carrying out works. However, due to the nature of tree surgery and grounds maintenance, minor disturbance to lawns, flowerbeds, driveways, or surrounding areas may occasionally occur.
We hold appropriate public liability insurance but shall not be liable for indirect, incidental, or consequential loss.
10. Tree Preservation Orders and Permissions
Unless otherwise agreed, it is the Customer’s responsibility to ensure that all necessary permissions are in place before work begins, including those relating to:
- Tree Preservation Orders (TPOs)
- Conservation Areas
- Any other legal restrictions
11. Delays and Force Majeure
We shall not be liable for delays or inability to complete works caused by:
- Adverse weather
- Restricted access
- Third-party actions
- Supply issues
- Any circumstances beyond our reasonable control
12. Completion of Work
Works will be considered complete once the agreed services have been carried out. Any concerns relating to completed work should be raised within 7 days so they can be reviewed promptly.
13. Health and Safety
We are committed to maintaining high standards of health and safety. Risk assessments are undertaken where required, and all works are completed in accordance with relevant health and safety legislation and industry requirements.
14. Insurance and Qualifications
JC Tree & Grounds Maintenance holds appropriate insurance and relevant industry qualifications required to carry out our services safely, professionally, and in line with current standards.
15. Complaints
If you are dissatisfied with any aspect of our service, please contact us in writing within 7 days of completion. We will aim to investigate and resolve all complaints fairly and professionally.
16. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
